Introduction These Terms & Conditions govern the use of this website and all services provided by ARK Fencing & Landscaping ("the Company", "we", "our", or "us"). By accepting a quotation, paying a deposit, booking our services, or using our website, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms & Conditions, please do not use our website or engage our services. 2. Quotations All quotations are provided free of charge unless otherwise stated. Quotations remain valid for 30 days from the date of issue. Quotations are based upon site conditions visible at the time of inspection. Should unforeseen circumstances arise during the course of works, additional charges may apply. Any variations, additions, or changes requested by the customer after acceptance of a quotation may result in additional costs. 4. Acceptance of Quotation A quotation shall be deemed accepted when: The customer confirms acceptance in writing; The customer instructs ARK Fencing & Landscaping to proceed with the works; A deposit is paid; or Materials are ordered on the customer's behalf. Acceptance of a quotation and payment of a deposit constitutes full acceptance of these Terms & Conditions. 5. Deposits and Payments A deposit may be required before work is scheduled. All deposits paid to ARK Fencing & Landscaping are strictly non-refundable. Deposits are taken to: Reserve and secure project dates; Cover administration and planning costs; Purchase and allocate materials; Commit labour and resources to the project; Protect the business from losses resulting from cancellations. By paying a deposit, the customer acknowledges and agrees that the deposit is non-refundable under any circumstances, including cancellation by the customer. Where a customer cancels a project after paying a deposit, ARK Fencing & Landscaping reserves the right to retain the deposit in full. The balance of all invoices becomes due immediately upon completion unless otherwise agreed in writing. Late payments may result in additional charges, interest, and debt recovery costs where permitted by law. Ownership of materials supplied by ARK Fencing & Landscaping remains with the Company until payment has been received in full. 6. Cancellations Customers wishing to cancel must do so in writing. Where cancellation occurs after acceptance of a quotation, the customer remains liable for: All materials ordered; Labour costs incurred; Plant hire charges; Waste disposal charges; Delivery costs; Any other costs reasonably incurred by ARK Fencing & Landscaping. Deposits shall remain non-refundable regardless of whether works have commenced. 7. Scheduling and Delays Any commencement or completion dates provided are estimates only. ARK Fencing & Landscaping shall not be liable for delays caused by: Adverse weather conditions; Supplier shortages; Delayed deliveries; Site access issues; Customer-requested changes; Events beyond our reasonable control. Where delays occur, project dates may be revised accordingly. 8. Customer Responsibilities The customer is responsible for: Providing unrestricted access to the work area; Obtaining any necessary permissions, approvals, or consents; Informing us of underground utilities, drainage systems, cables, pipes, or other hazards; Removing personal belongings from the work area before works commence. ARK Fencing & Landscaping shall not be liable for damage resulting from undisclosed underground services or site conditions. 9. Materials Natural products including timber, turf, aggregates, paving, and stone may vary in colour, texture, appearance, and finish. Such variations are normal and shall not be regarded as defects. Material availability may occasionally require substitutions of similar products where necessary. 10. Workmanship Guarantee ARK Fencing & Landscaping guarantees its workmanship for a period of 12 months from completion unless otherwise stated in writing. This guarantee does not cover: Fair wear and tear; Storm damage; Flooding; Ground movement or settlement; Timber movement, shrinkage, splitting, or warping; Lack of maintenance; Third-party damage; Alterations made by others. Manufacturer warranties remain subject to the manufacturer's own terms and conditions. 11. Website Use The content of this website is provided for general information purposes only. You may not: Reproduce website content without permission; Use the website for unlawful purposes; Attempt to gain unauthorised access to website systems. ARK Fencing & Landscaping reserves the right to amend website content without notice. 12.
